Publika Amorale Ltd is a company registered in England and Wales. References to "we", "us", or "our" in these Terms and Conditions refer to Publika Amorale Ltd.

2. Scope of These Terms

These Terms and Conditions govern your use of the Website and any purchase of products or services made through it, including:

  • Physical merchandise (clothing, accessories, and other branded items);

  • Event tickets for live performances and concerts; and

  • Digital music and audio content (downloads and digital releases).

These Terms and Conditions are supplemented by our Privacy Policy, which explains how we collect and process your personal data. By using the Website, you also agree to our Privacy Policy.

 

3. Eligibility

By placing an order, you confirm that any information you provide is accurate and complete. We reserve the right to cancel orders placed by persons who do not meet these requirements.

4. Account Registration

Some features of the Website may require you to create an account. When registering, you agree to:

  • Provide accurate, current, and complete information;

  • Keep your login credentials confidential and secure;

  • Notify us immediately if you suspect any unauthorised access to your account;

  • Take responsibility for all activity that occurs under your account.

We reserve the right to suspend or terminate accounts that violate these Terms and Conditions or that we reasonably believe have been compromised.

5. Products and Services

5.1 Merchandise

We sell physical merchandise through the Website. Product descriptions, images, and specifications are provided for guidance only. While we take care to ensure accuracy, slight variations in colour or finish may occur due to screen calibration and manufacturing. We reserve the right to modify or discontinue products at any time.

5.2 Event Tickets

Tickets sold through the Website grant you a personal, non-transferable licence to attend the specified event. The following conditions apply to all event ticket purchases:

  • Tickets are issued subject to the specific terms and venue rules of each event. By purchasing a ticket, you agree to comply with those rules.

  • We reserve the right to refuse entry or eject any person behaving in a manner that, in our reasonable opinion, is disruptive, dangerous, or unlawful.

  • If an event is cancelled or significantly altered by us, please refer to Section 9 (Cancellations and Refunds) for your rights.

  • Tickets must be presented (digitally or in print) at the venue entrance. We accept no liability for lost or stolen tickets.

 

5.3 Digital Music

Digital music and audio content sold through the Website is delivered electronically as downloadable files. By purchasing digital content, you acknowledge that:

  • You are purchasing a personal, non-exclusive, non-transferable licence to use the digital content for private, non-commercial purposes only.

  • You may not reproduce, distribute, publicly perform, broadcast, or otherwise exploit the content beyond your own private listening.

  • All intellectual property rights in the digital content remain with Publika Amorale Ltd and/or the relevant rights holders.

  • Digital downloads are delivered immediately upon confirmed payment. Please see Section 9 for cancellation rights applicable to digital content.

 

6. Pricing and Payment

All prices displayed on the Website are stated in the currency shown at checkout. We reserve the right to change prices at any time; however, the price charged will be that displayed at the time you place your order.

We accept the following payment methods:

  • Major credit and debit cards (Visa, Mastercard, American Express);

  • Other payment methods as displayed at checkout.

Payment is processed securely through our payment provider. We do not store your full card details on our servers. Your order is confirmed only upon successful payment processing. We reserve the right to cancel any order if payment cannot be successfully collected.

 

7. Orders and Contract Formation

When you place an order on the Website, you are making an offer to purchase the product or service at the stated price. A legally binding contract between you and Publika Amorale Ltd is formed only when we send you an order confirmation email. We reserve the right to decline or cancel any order at our discretion, including in cases of:

  • Pricing or product description errors;

  • Suspected fraudulent activity;

  • Stock unavailability;

  • Failure to meet eligibility requirements.

If we cancel your order after payment has been taken, we will issue a full refund to your original payment method within 14 business days.

 

8. Delivery of Physical Merchandise

We ship merchandise to the delivery addresses accepted at checkout. Estimated delivery times are provided at the point of purchase and are indicative only — we do not guarantee delivery by any specific date. Delivery timescales may vary depending on your location and the shipping carrier. We are not responsible for delays caused by customs clearance, carrier disruptions, or circumstances beyond our control.

Risk of loss or damage to merchandise passes to you upon delivery to the address specified in your order. Title to merchandise passes to you upon full payment.

If your order does not arrive within 30 days of the estimated delivery date, please contact us using the details in Section 15.

9. Cancellations, Returns, and Refunds

9.1 Merchandise — Consumer Right to Cancel

If you are a consumer based in the United Kingdom or European Union, you have the right to cancel your purchase of physical merchandise within 14 calendar days of receiving the goods, without giving any reason. To exercise this right, you must notify us in writing (email is acceptable) before the 14-day period expires.

Following notification of cancellation, you must return the merchandise to us in its original, unused, and undamaged condition within 14 days. Return postage costs are your responsibility unless the goods are faulty or were misdescribed. Upon receipt and inspection of the returned goods, we will issue a full refund to your original payment method within 14 days.

The right to cancel does not apply to merchandise that has been personalised or custom-made to your specifications.

 

9.2 Event Tickets — No Cancellation Right

In accordance with applicable consumer legislation, event tickets are exempt from the standard 14-day right to cancel, as they relate to leisure services for a specific date. All event ticket sales are therefore final unless the event is cancelled, rescheduled, or significantly altered by us.

If an event is cancelled by us, you will be entitled to a full refund of the face value of the ticket. If an event is rescheduled, we will notify you and offer you the option to either attend the rescheduled event or receive a full refund. Refunds will be processed within 30 days of cancellation or, in the case of rescheduling, within 30 days of your refund request.

We accept no liability for any travel, accommodation, or other ancillary costs incurred in connection with attending an event.

 

9.3 Digital Music — No Cancellation Right After Download

In accordance with applicable consumer legislation, you lose the right to cancel a purchase of digital content once downloading has begun and you have acknowledged that your right to cancel is waived by doing so. We will seek this acknowledgement from you at the point of purchase.

If you experience a technical issue with your digital purchase, please contact us promptly and we will endeavour to resolve the issue or provide a replacement file.

9.4 Faulty or Misdescribed Goods

If any physical merchandise you receive is faulty, damaged in transit, or not as described, please contact us within 30 days of receipt. We will arrange a return and offer you a replacement or a full refund, including reasonable return postage costs.

10. Intellectual Property

All content on the Website — including but not limited to the Sirdsapes name, logo, artwork, music, photography, text, and design — is the property of Publika Amorale Ltd or its licensors and is protected by copyright, trade mark, and other applicable intellectual property laws.

You may not reproduce, copy, distribute, transmit, publicly display, sell, or otherwise exploit any content from the Website without our prior written permission. Unauthorised use of our intellectual property may give rise to legal action.

The Sirdsapes trade mark and any associated logos are the property of Publika Amorale Ltd. Nothing in these Terms and Conditions grants you any licence to use our trade marks.

11. Acceptable Use

You agree not to use the Website for any unlawful or prohibited purpose, including:

  • Violating any applicable local, national, or international law or regulation;

  • Transmitting any material that is defamatory, offensive, or otherwise objectionable;

  • Attempting to gain unauthorised access to the Website or its systems;

  • Introducing viruses, malware, or other harmful software or code;

  • Scraping, crawling, or systematically extracting data from the Website without our permission.

We reserve the right to restrict or terminate your access to the Website if you breach these provisions.

12. Third-Party Links and Services

The Website may contain links to third-party websites or services, including payment processors, ticketing platforms, or social media channels. These links are provided for your convenience only. We have no control over the content or practices of third-party sites and accept no responsibility for them. 13. Limitation of Liability

To the fullest extent permitted by law, Publika Amorale Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Website or the purchase of any products or services, including loss of profits, loss of data, or loss of goodwill.

Our total aggregate liability to you in connection with any order or use of the Website shall not exceed the amount paid by you for the specific product or service giving rise to the claim.

Nothing in these Terms and Conditions excludes or limits our liability for: (i) death or personal injury caused by our negligence; (ii) fraud or fraudulent misrepresentation; (iii) any breach of your statutory rights that cannot be excluded under applicable consumer law; or (iv) any other liability that cannot be excluded or limited by law.

We are committed to protecting your personal data. Our Privacy Policy, available on the Website, explains in detail what personal data we collect, how we use it, the legal bases for processing, and your rights under applicable data protection law (including the UK GDPR and, where applicable, the EU GDPR).

These Terms and Conditions are governed by and construed in accordance with the laws of England and Wales. Any disputes arising out of or in connection with these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts of England and Wales, except that if you are a consumer residing in another jurisdiction, you retain the benefit of any mandatory consumer protection laws applicable in your place of habitual residence.

17. Changes to These Terms

We may update these Terms and Conditions from time to time to reflect changes in law, our business, or our products and services. We will post the revised Terms on the Website with an updated "Last updated" date. Where the changes are material, we will notify you by email (if you have an account with us) or by a prominent notice on the Website.
